(At least with your lawyer.)<\/h1>\n\n\n\n

AI is very useful but…<\/h2>\n\n\n\n

The allure of AI is undeniable. I present to lawyers\u2014locally and nationally\u2014about the expanding role AI will play in the legal profession.<\/p>\n\n\n\n

But when something feels \u201ctoo good to be true,\u201d it usually is.<\/p>\n\n\n\n

And while we\u2019re still in the early days of the AI boom, we already know many of the pitfalls. Here\u2019s one you may not be considering:<\/p>\n\n\n\n

Using AI in your communications with your lawyer may be costing you more money than you think.<\/strong><\/p>\n\n\n\n

The pattern we\u2019re seeing<\/a><\/h2>\n\n\n\n

More and more, clients are communicating with us through AI.<\/p>\n\n\n\n

We can usually tell right away: the traditional font, the bolded subject headers, the tidy bullet points\u2014and the tone. And in these emails (the length of which tends to be unmanageable), clients use AI to \u201cexplain\u201d the law to us.<\/p>\n\n\n\n

The problem is: these AI platforms always (and we do mean, always) steer clients in the wrong direction.<\/strong><\/p>\n\n\n\n

Most of the time, the \u201claw\u201d cited is just plain wrong.<\/p>\n\n\n\n

For example, I asked ChatGPT to list the custody factors in Pennsylvania. It missed them.<\/p>\n\n\n\n

Not most of them\u2014all of them<\/strong>.<\/p>\n\n\n\n

It created new custody factors, ignored the real factors, and tried to tell me I was wrong.<\/p>\n\n\n\n

Why AI gets it wrong (even when it sounds right)<\/a><\/h2>\n\n\n\n

AI tools (including ChatGPT, Claude, Copilot, and many others) do not know<\/em> the law.<\/p>\n\n\n\n

That\u2019s a dangerous combination in a legal case where every move has a consequence.<\/p>\n\n\n\n

The hidden cost: you pay for the cleanup<\/a><\/h2>\n\n\n\n

Attorneys spend three years in law school learning the law\u2014but, more importantly, learning how to analyze it, synthesize it, and use their education and skills to represent you. They spend the rest of their careers sharpening those skills, building relationships, and learning how to navigate the legal system.<\/p>\n\n\n\n

There is so much more to the practice of law than just the words in the Rules. The practice of law involves understanding the courts and our clients\u2014and knowing how to strategize and plan to our clients\u2019 advantage.<\/p>\n\n\n\n

The documents AI drafts are nearly always wrong: they cite imaginary or incorrect rules, and they summarize the law incorrectly.<\/p>\n\n\n\n

When this happens, we must spend hours:<\/p>\n\n\n\n

  1. <\/li>\n<\/ol>\n\n\n\n

    AI isn\u2019t saving you time.  It\u2019s creating more work\u2014and more costs\u2014for you.<\/strong><\/p>\n\n\n\n

    A better way to use AI (without letting it misdirect you)<\/a><\/h2>\n\n\n\n

    We understand why clients turn to AI.<\/p>\n\n\n\n

    Legal jargon is confusing. The process can feel mysterious and frustrating. Continuing to find ways to conserve costs and better understand the legal process is commendable.<\/p>\n\n\n\n

    However, relying on AI as \u201ctruth\u201d\u2014or using it to guide your attorney\u2019s strategy\u2014is not advisable.<\/p>\n\n\n\n

    The costs are high:<\/p>\n\n\n\n

    If you\u2019re using AI, tell your lawyer<\/a><\/h2>\n\n\n\n

    Be open with your lawyer about your use of AI.<\/p>\n\n\n\n

    We already know you\u2019re using it.<\/p>\n\n\n\n

    Help us understand what you\u2019ve read and what concerns you\u2014so we can better help you.<\/p>\n\n\n\n
